This notice describes how medical and mental-health information about you may be used and disclosed and how you can access this information. Please review it carefully.This notice applies to protected health information maintained by Grace Out Loud Therapy & Consulting, LLC in connection with therapy and other healthcare services.

Your Rights

You have the right to:obtain an electronic or paper copy of your health record request a correction to your health record request confidential communications ask us to limit certain uses or disclosures obtain a list of certain disclosures of your information receive a copy of this notice choose someone to act on your behalf file a complaint if you believe your privacy rights have been violated.

Get a Copy of Your Health Record

You may ask to inspect or receive an electronic or paper copy of your health record and other health information we maintain about you.We will generally provide a copy or summary within 30 days of receiving your request. We may charge a reasonable, cost-based fee as permitted by law. Certain information, including separately maintained psychotherapy notes, may be excluded from the right of access when permitted by law.

Ask Us to Correct Your Health Record

You may ask us to correct health information that you believe is incorrect or incomplete.We may deny the request in some circumstances. If we do, we will explain the reason in writing, generally within 60 days.

Request Confidential Communications

You may ask us to contact you in a specific way—for example, only by telephone, secure portal, email, or mail—or to send communications to a different address.We will agree to reasonable requests. You are responsible for giving us accurate contact information and informing us when your preferences or information change.

Ask Us to Limit What We Use or Share

You may ask us not to use or disclose certain health information for treatment, payment, or healthcare operations.We are not always required to agree to a requested restriction. We may deny a request when, for example, the restriction could affect your treatment or our ability to provide services. If we agree to a restriction, we may still disclose the information if emergency treatment is necessary.If you pay for a healthcare service entirely out of pocket, you may ask us not to disclose information about that service to your health insurer for payment or healthcare operations. We will agree unless disclosure is required by law.

Get a List of Certain Disclosures

You may request an accounting of certain disclosures of your health information made during the six years before your request.The accounting will not include certain disclosures, such as those made for treatment, payment, healthcare operations, disclosures you authorized, or other disclosures excluded by law.We will provide one accounting during any 12-month period without charge. We may charge a reasonable, cost-based fee for additional requests within the same 12-month period.

Receive a Copy of This Notice

You may request a paper copy of this notice at any time, even if you agreed to receive it electronically. We will provide a copy promptly. A current copy is also available at www.graceoutloudtherapy.com.

Choose Someone to Act for You

If you have authorized someone to act as your personal representative, or if someone has legal authority to act for you, that person may exercise your privacy rights and make choices about your health information.We will verify that the person has appropriate authority before taking action.

Your Choices

For certain health information, you may tell us your preferences regarding what we disclose.You may tell us whether we may:share information with family members, close friends, or others involved in your care or payment for your careshare information in a disaster-relief situationcommunicate with another person you identify about your treatmentIf you are unable to communicate your preference, we may disclose limited information when we believe it is in your best interest or when necessary to reduce a serious and imminent threat to health or safety, as permitted by law.We will generally obtain your written authorization before:using your information for marketing purposesselling your health informationdisclosing most psychotherapy notesusing or disclosing your information for purposes not otherwise described in this noticeGrace Out Loud does not sell protected health information.If you provide written authorization, you may revoke it in writing at any time. Revocation will not affect actions already taken in reliance on the authorization.

How We Typically Use or Share Your Information

Treatment

We may use your health information and share it with other professionals involved in your care.For example, with appropriate permission or when otherwise allowed by law, we may coordinate with a physician, psychiatrist, or another treating professional.

Practice Operations

We may use and disclose health information to operate our practice, improve services, conduct quality-review activities, provide supervision or consultation consistent with applicable confidentiality requirements, manage records, and contact you when necessary.When clinical information is discussed for supervision or consultation, we will limit identifying information when practicable and follow applicable legal and ethical requirements.

Payment

We may use and disclose health information to bill for services and obtain payment from health plans, payment processors, billing providers, or other responsible parties.This may include sharing information with insurance companies or billing platforms, including Headway, as necessary to determine eligibility, submit claims, obtain authorization, process payment, or address billing questions.

Other Uses and Disclosures Permitted or Required by Law

We may use or disclose health information in other circumstances when permitted or required by federal or state law. Additional legal conditions may apply before a disclosure is made.

Public Health and Safety

We may disclose health information for authorized public-health and safety purposes, including:preventing or controlling disease reporting adverse reactions to medications reporting suspected abuse, neglect, exploitation, or domestic violence when required or permitted preventing or reducing a serious and imminent threat to someone’s health or safety.

Health Oversight

We may disclose information to health-oversight agencies for legally authorized activities, such as audits, investigations, inspections, licensure reviews, or compliance proceedings.

Compliance With Law

We will disclose health information when federal or state law requires it, including to the U.S. Department of Health and Human Services when it is reviewing our compliance with federal privacy law.

Workers’ Compensation

We may disclose health information as authorized by and necessary to comply with workers’ compensation laws or similar programs.

Law Enforcement and Government Requests

We may disclose health information for certain law-enforcement purposes or government functions when authorized or required by law. Additional protections may apply to mental-health records, psychotherapy notes, and substance-use-disorder records.

Judicial and Administrative Proceedings

We may disclose information in response to a valid court or administrative order. We may respond to a subpoena or other lawful process only when the legal requirements for disclosure have been satisfied.

Medical Examiners and Funeral Directors

We may disclose health information to a coroner, medical examiner, or funeral director when permitted or required following an individual’s death.

Research

Grace Out Loud does not use client information for research. If health information is ever used or disclosed for research, it will be done only with your authorization or as otherwise permitted under applicable law.

Organ and Tissue Donation

When applicable and permitted by law, health information may be disclosed to organizations involved in organ, eye, or tissue donation and transplantation.

Special Protections for Mental-Health Information

Mental-health records, psychotherapy notes, substance-use-disorder records, and certain other information may receive protections that are stricter than general HIPAA requirements. When state or federal law provides greater privacy protection, Grace Out Loud will follow the more protective law.We will not disclose mental-health treatment records or psychotherapy notes without written authorization unless the disclosure is permitted or required by applicable law.To the extent Grace Out Loud maintains substance-use-disorder patient records protected by 42 C.F.R. Part 2, those records will not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you without your written consent or a qualifying court order and subpoena, as required by law.

Couples and Family Therapy

When services involve a couple or family, information may be created or received concerning more than one participant. Access, authorization, confidentiality, and record-release questions may therefore involve the rights and interests of multiple people.Grace Out Loud will manage these records according to applicable law, the applicable service agreement, and the practice’s couples or family therapy policies. Participation in couples or family therapy does not automatically authorize disclosure of the clinical record to every participant or outside party.

Our Responsibilities

Grace Out Loud is required by law to:maintain the privacy and security of protected health information, provide this notice describing our legal duties and privacy practices, follow the terms of the notice currently in effect, and notify affected individuals promptly if a breach occurs that may have compromised the privacy or security of their information. We will not use or disclose your information for purposes not described in this notice unless you authorize us in writing or the law otherwise permits or requires the disclosure. You may revoke an authorization in writing at any time. We cannot reverse disclosures already made in reliance on a valid authorization.

Electronic Services and Business Associates

Grace Out Loud may use third-party service providers to support treatment, payment, or healthcare operations, including electronic health records, telehealth, scheduling, billing, insurance, secure communications, document storage, and payment processing. When a service provider is acting as a HIPAA business associate, we require appropriate written assurances that it will safeguard protected health information as required by law. Clients may be directed to Headway or another secure platform for intake, scheduling, insurance, billing, telehealth, or account management.

Changes to This Notice

We may change the terms of this notice. Any revised notice may apply to all health information we maintain, including information created or received before the revision.The current notice will be available upon request and posted at www.graceoutloudtherapy.com.
